I saw this over the weekend and my wife and I had a conversation about who's in the wrong. Usually no ATC on waterways and I'm sure the plane had cleared his route until the boat came into view.

On the other hand, as a boater on a larger body of water, I'm looking for boats in the near range, not a plane that's probably started out of view and got up to 70-80 mph during takeoff. That said, the boater probably should've had more situational awareness IF he was aware that that water was used for flights.

Seaplane basin w/ATC - plane had the right of way, boater was arrested for BUI.

The boat operator should have seen this coming and avoided the collision, but impairment makes sense.

We learned a great lesson on Lake Union in Seattle. When the yellow buoys start flashing it's time to get away from the waterway/runway. We were never in the way but I DID have to ask what they meant. I imagine most people don't deal with the airplane traffic on their local waters ever/or very often.

Interesting situation. I didn't realize that zones like that existed...good to know.

New York rules are clear regarding sea planes. The Marine Services Bureau (part of the NYSDEC) which is the agency responsible for issuing a Public Vessel License, clarifies the hierarchy of right-of-way. I'm sure this changes when operating in a zone that is primarily designated for seaplane operation, and when there's a BUI involved. But in general practice in NY waterways, the seaplane is always the give-way vessel. And, of course, every operator is responsible for avoiding a collision whether you have the right of way or not.

Crazy.... I was just there on a trip last week. Sat there with a large coffee and just watched planes takeoff and land all morning. Loved it and totally geeked out. Saw that Beaver as well. One of the few Birds that was non-turbine and I loved the old school radial.

Sad event for everyone
