PA courts overturned the K-12 mask mandate and is leaving the decision up to the school districts to decide on requiring masks or not. The mandate is still in effect until an appeal is heard. Now when people go to school board meetings and act like idiots at least the school board does have the authority now to remove the mask requirements. Then there will be parents on the other end wanting a mask requirements and there will be lawsuits from them saying the schools aren't protecting the students. Even though the decision to mask will be up to the school districts, daycares and early learning programs are still required to wear masks, how in the hell does this make sense?

Actually, not much has changed. This is the same court that approved a temporary stay.

What I wrote on the last page of this thread is still valid, "The 5th Circuit Court granting a stay in this case has been unusual as the mandate does not require employers or employees to act until January 4th. When several petitioners are challenging the same rule in several circuits, the cases are ultimately consolidated in one circuit through a process known as the "multicircuit lottery." A Judicial Panel on Multidistrict Litigation then conducts a blind lottery and chooses a circuit at random and all the cases challenging a rule are transferred to it. This could result in another court (the one winning the lottery) end up hearing the cases filed in the Fifth Circuit and lifting the Fifth Circuit's stay."

The federal court may find the OSHA rule to indeed be over reach and the rule to be arbitrary and capricious, or maybe not. We will have to see what the circuit court assigned to the case and the Supreme Court rules. My guess is that we will see a narrow ruling regarding the rule's validity as an Emergency Temporary Standards (ETS)

@Tgen2013 I admit my wish would be that everyone not medically prevented from vaccinating did so, for their own benefit as well as for the benefit that extends to me. I also find the commerce clause has been revised by the courts to affect intra-state commerce indiscriminately. (Say whether you get vaccinated, or safety measures at work dictated by federal powers without adoption by the states..Where is the sovereignty?)

Why the commerce clause affects a widget factory that sells only inside a state, has been explained to me, but not in a way that convinces me. This was a slippery slope from 1942 on.

If they can tell a wheat farmer how much wheat to plant in his own farm, for his OWN consumption, how the hell can they not tell you to vaccinate? This needs to be reconciled, and perhaps commerce clause constrained a little?

This will spend a long time on the courts for sure. If I had a choice between your mandated vaccination or the commerce clause being pulled back, I probably would pick the second one. It's great for the states to have more ability to try different things so we can pick and adopt what works. Commerce clause++ I think is way more power than originally intended for the feds. (Same for Lesser rights for citizens within 100 miles from the border https://www.aclu.org/know-your-rights/border-zone/)

With vaccines available now for under 12, my younger one will be fully vaccinated soon (just got his first shot, no side effects), and he was already at low risk, after having had Covid last December. So selfishly I care a little less if you vaccinate or not, but for the hospital usage alone and death reductions, it seems to make a LOT of sense to get vaccinated, and I perhaps do agree with you (maybe, guessing your opinion) that this would be more appropriately a State issue vs. a Federal one.

Sorry if this got too political, hoping to keep it civil and respectful.

My guess is that the Commerce Clause and the laws/regulations will probably not be addressed in the court rulings. Rather, I think the courts likely will rule on a much more narrow question and will find the way the federal mandate came about, through Emergency Temporary Standards (ETS) to be arbitrary and capricious.

My guess is that the state anti-mask and anti-vaccine mandates will also run afoul in the courts.

Can you share more on why you think the states are unable to issue those mandates? If anything, the states have a lot of leeway in these matters as far as I understand.

Because the politicians want to be re- elected. The states should make the decisions s either way, that would take a spine though. Each state has a unique situation , make up.
All contentious issues should be decided at the state level.
If not the only way for a central issued mandate would come from the legislative branch. Not the executive.

That's kind of is the crux of what's going on today in general. Many of us believe in "The Republic", and state sovereignty local control. Others are leaning on autocratic, central Federal authority garbage.

The "choose not to" is my experience in life and politicians, actually in any institution or organization. People of strong character and principle almost never rise to high office or rank. Spine/character are looked down on, morphing self centered, self interested, compromise, rules today.
 
@Tgen2013 The day all politicians are seen as corrupt, and the role of politician seen as a job only for the "bad apples" is the beginning of the end. I know from Experience. That's how Venezuela was destroyed. (where I was born) For an entire generation, politics was only for the corrupt politicians, so decent people would not engage in exposing themselves to the dirtiness of political office... 80s 90s self fulfilling prophesy became true soon enough, and by then most all politician were only of the moral character required to pick a crooked profession. Chavez arrived with his siren song to "clean it up", and most of the country followed him into the abyss. An offer of vengeance on the establishment and magical reforms and "stop the corruption" has left the country, in only 22 years, as if the most horrendous natural disaster had occurred. Earthquake? Nuclear Bomb? no, ALL self inflicted. About 10% of the country could CLEARLY see what was coming (as a kid I did not, but my parents did and told me so), and it was like watching a stamped come in slow motion. The currency has been now adjusted to remove 14 zeros in the last 10 years. Average yearly Inflation of 2000% + yearly for 5 years. No end in sight.

I know it's a totally different topic, It has been my impression if I only engage at voting time, and I am not happy with the choices presented to me in the ballot, I'm too late, and need to be involved earlier in the process to help shape the choices available.

Sorry for the political context, let's call it a political history anecdote.
